Control - packages in I. trimester 2010

(Prague, April 27, 2010) Since January till March the Czech Trade Inspection performed controls with focus on abidance with the Act on Packaging. The control activity was performed by all inspectorates of the Czech Trade Inspection on the whole territory of the Czech Republic. The control was held at sellers of the some kinds of drinks, i.e. in shopping malls and other branches with the particular assortment and at persons introducing packages to the market (producers and importers of packages).

In total there were 433 branches controlled in the I. trimester 2010. There were 425 controls (98,2 %) performed at selling persons with focus on fulfilment of requirements on sell of drinks in returnable and buy back packages and 8 controls at persons introducing the packages to the market. Deficiencies were found in 30 controlled branches, i.e. 6,8 % of the total number of controlled branches.

 

The inspectors found infringements of the duty to offer the same drinks in returnable packages when selling such drinks in non-returnable packages in premises of 200 m2 or larger. Law infringement was found in 26 cases, i.e. in 6,0 % of the total number of controlled premises. In 1 case was found the infringement of the duty of the body placing goods in returnable packages on the market or selling the packages to buy back the packages with no limitation in number and without fixing this buy-out on new products purchase.

 

 

A control on law-abidingness at producers’ and importers’ side was performed in 8 premises, i.e. 1,8 %. Infringement of law was found at 3 producers’ when in the time of the control the checked body was not able to provide required technical documentation proving the packages had been examined on the content of heavy metals and dangerous substances. In two of these controls, the Czech Environmental Inspectorate cooperated with the CTI.

 

Within the controls on the Act on packaging also infringements of the Consumer Protection Act were detected at 183 (i.e. 42,3 %) controlled subjects. Mostly it was when the shopping assistant did not inform the consumer on the amount for the buy-out of returnable packages and when information on returnable package’s price was missing at the drinks.

 

The detected deficiencies are the grounds for launching administrative proceedings and in 62 cases fines were issued at the inspection location in the amount of 70.700 CZK.
