Controls on observance of Act on packaging - controls in trimester IV of 2009
(Prague, January 28, 2009) Since October till December the Czech Trade Inspection Authority performed further controls focused on observance of statutory duty according to the Act on packaging and the Act on consumer protection.

The control was performed by inspectors from all the inspectorates of the CTIA in the whole Czech Republic. These controls were held in chain stores and other premises of relevant range of goods and at producers and importers who bring packages on the market.

In the fourth quarter of the year in total 288 premises were checked and insufficiencies were found in 37 of them, i.e. in 12,8 %.

 

279 premises, i.e. 96,9 %, were checked on law-abidingness when selling drinks in returnable packages. The inspectors found infringements of the duty to offer the same drinks in returnable packages when selling such drinks in non-returnable packages in premises of 200 m2 or larger. This law-abidingness was found in 9 cases, i.e. in 3,1 % of the total number of controlled premises. In 23 cases the seller didn’t inform the consumer on the price of the returnable package. In 9 cases the information on the returnable package’s price was missing in the moment of the offer. In 1 case was found the infringement of the duty of the body placing goods in returnable packages on the market to buy back the packages with no limitation in number and without fixing this buy-out on new products purchase.

 

A control on law-abidingness at producers’ and importers’ side was performed in 9 premises, i.e. 3,1 %. Law-breaking was found at 1 producer when in the time of the control the checked body was not able to provide required technical documentation proving the packages had been examined on the content of heavy metals and dangerous substances.

 

In 17 cases the fines of 20.000 CZK were imposed at the halt and in 1 case a so called block fine of 500 CZK was imposed. In 21 cases the found insufficiencies were a reason for starting an administrative procedure.

 

Within the controls on the Act on packaging also breaches of the Act on consumer protection were found. In 12 cases there was an incorrect pricing or the products were sold in an incorrect weight. As well in 12 cases the consumer was not informed on the price of the sold products in any solid way. In 5 cases the sellers used officially unverified measuring instruments. In 7 cases receipts were not given out after consumer’s demand and in 4 cases the consumer was not informed in any solid way on the restriction to sell alcoholic drinks to persons below 18 years of age.
