Custom-made services? Only with written order!
(Hradec Králové, July 11, 2011) In May and June, CTIA inspectors in the Královéhradecký and Pardubický regions focused on controls of custom-made services providers, especially on written confirmation of order acceptance with all belongings and on informing about prices of provided services. Results were not very satisfactory: out of 29 controlled subjects, the Act on Consumer Protection was breached in 17 cases, i.e. 58.6%.
The control’s objective was to check how providers of custom-made services abide with statutes of the Act on Consumer Protection – concretely whether the written confirmations about acceptance of an order include all required information and how consumers are informed about prices. During May and June, control of 29 various services concerning custom made products were carried out; these services included tailor’s, photographer’s, cleaner’s, tinsmith’s, production of advertising products and so forth. In 17 cases (i.e. 58.6%), one or more statutes of the Act on Consumer Protection were breached. 

A controlled producer of advertising tools did not give out any written confirmation about the acceptance of the order despite the service was not provided immediately. The order was just filed in a working sheet. Administrative proceedings will be launched with the service provider. This obligation defined by the Act on Consumer Protection – to give out an order concerning custom-made services - was breached in other 15 controlled subjects.

In other 2 cases, consumers were not informed about prices of custom-made services. One case was a cleaner shop and laundry seated in Prague. The seller failed the obligation to inform consumers about prices of services such as cleaning of various types of clothes, textiles, mangling, feather cleaning and so forth. He did not inform customers about prices in any price list or in any other appropriate way.

In all 17 cases, controlled persons will be imposed sanctions in administrative proceedings and workplaces providing custom-made services will still be objects to controls. A customer is in failure of evidence when he does not receive any properly prepared custom sheet in case a service is not provided immediately and when a dispute concerning service’s quality occurs. Such circumstance significantly restricts consumer’s possibilities to enforce his rights later on.
