Consumer Rights: Advice and Information

The buyer’s rights, or the corresponding responsibilities of entrepreneurs during the manufacture, import, distribution and sale of products, can be found in a range of special legislation related to the specific commodity or to certain properties of the product, etc. (For example, responsibilities relating to the sale of fuel for motor vehicles under Act No. 311/2006 Coll. the Fuels Act; in the case of food it is Act No. 110/1997 Coll., the Foodstuffs and Tobacco Products Act; while health and safety requirements for the materials used in products for children under three years of age, or products intended for contact with food are governed by Act No. 258/2000 Coll., the Protection of Public Health Act.)

Consumer rights legislation that has a wider impact can be found primarily in the following regulations:

  • Act No. 89/2012 Coll., the Civil Code
    This act contains, in particular, the provisions of the purchase agreement, namely the section on the sale of goods in a store, the provisions on the so-called consumer contracts, contracts concluded on-line or outside of the usual commercial premises, regulation of liability for damage caused by defective product and a number of other provisions to protect the weaker party.
  • Act No. 634/1992 Coll., on Consumer Protection
    This act stipulates various responsibilities during the sale of products, for example, the requirement of honesty during the sales process, the prohibition of unfair trade practices, the prohibition of discrimination of the consumer, requirements to provide information about the characteristics and uses of the product, proper information on the application of consumer complaints and formally correct course of the complaint procedure (i.e. not the factual correctness of a decision on a complaint - such disputes can only be decided by the court of law or an arbitrator).   • Act No. 145/2010 Coll., on Consumer Credit
    This act specifies, inter alia, certain consumer rights with respect to purchases paid by instalments or to obtaining consumer loans, etc.
  • Act No. 102/2001 Coll., on General Product Safety
    This act imposes general responsibilities on manufacturers and importers to market only safe products. The consumer is entitled to return hazardous products, with all associated return costs paid by the manufacturer or distributor.
  • Act No. 526/1990 Coll., on Prices
    This act, inter alia, regulates the process of setting prices and the method of pricing goods.
  • Act No. 455/1991 Coll., on Self-Employment and Entrepreneurship
