Fakes and other findings in the city centre of Prague

(Prague, March 3, 2011) Luxury goods sellers in the heart of Prague and sellers in some shopping malls were very much surprised to find out that their customers were indeed inspectors of the Czech Trade Inspection. The objective of the controls performed from February 15 to March 1, 2011, was to check how obligations provided by the Act on Consumer Protection are abided just before the start of the touristic season. The results of this extraordinary control activity were also extraordinary – having controlled 31 workplaces, the inspectors detected breaches of obligations in 30 of them. After issued measures, the controlled subjects can await also administrative proceedings and subsequently fines.

Luxury candies – in total 8 workplaces were controlled and the law was breached in 7 of them – within 5 purchases, products were weight together with the packaging material and in 3 cases of these, the damage to consumer was higher than CZK 10.

 

Refreshment (sale of fruit juices and sliced fruit in plastic packages) – the inspectors did not have the chance to check the declared amounts as the seller did not hold any certified weighs nor glass of content. Within a weighing by random meth, the difference was more than 80 g per pot – which makes almost 1/3 or ¼ of content depending on the declared amount and the used pot.

 

Cafe in the Železná Street - on the bill there were 2 prices, for example CZK 100 and 115, and the service staff returned money counting the higher prices. In this case, the difference was CZK 15 detrimental to the consumer.

 

Luxury goods shops – defects in goods pricing and missing information were detected. Due to breaching informational obligations, bans were issued on sale of totally 79 pieces of watches and jewels in the price of tens of millions of crowns.

 

Shopping Mall Paladium – in a stall where hair irons are sold, the seller (of foreign nationality) left the place of sale. The inspectors detected sale of without pricing and without any manual in the Czech language, this is why they issued ban on 40 pieces of goods. In a teeth care stall, the consumer was not informed about the price. Apart from this, the place of sale was not marked in conformity with the Trade Licensing Act – the finding will be transferred to the appropriate trade licensing office.

 

River Side Marketplace in Holešovice – the control was focused on offering, selling or stocking of products infringing the intellectual property rights. Also members of the Police of the Czech Republic – Alien Police Service and the Municipality Directorate of the Capital of Prague, also participated in the controls of 4 stalls situated in the Dejvická and Břevnovská Streets in the marketplace’s area. In all these cases, sale of products infringing intellectual property rights was detected. The CTI inspectors took totally 102 pieces of products, mostly of the trade-marks Louis Vuitton, Burberry, Diesel, Lacoste, Nike, O´Neill a Replay. The price of the originals would be over CZK 1.1 million.

 

Boutiques in Železná and Rybná Street – within the controls in 3 shops, goods infringing intellectual property rights were taken, for example umbrellas, scarves and kerchiefs marked with the trade-mark Burberry. The value of the originals would be about CZK 170,000.

 

Shopping malls – within the control of 3 boutiques selling textile products, bans on sale were issued concerning goods in the value of about CZK 260.000. This was due to breaching informational obligations.

           

All the controls were performed in the frame of a new approach towards control activities, respectively after foregoing operative fieldwork and its evaluation. In the context of the number of findings, the Acting Director General of the CTI Ing. Jan Štěpánek decided that these actions would continue also in the following period.
