Authorities revoked trade licences of organizers of demonstration sales events

(Prague, September 19, 2013) The Czech Trade Inspection Authority suggests trade licensing offices to revoke trader’s licences when there are significant and repeated violations of laws and when sanctions and taken measures are ineffective. This year, trade licensing offices have lawfully decided to revoke trade licences of four companies that organized demonstration sales events for seniors. “I get huge satisfaction, knowing that other authorities also punish unfair entrepreneurs who significantly violate laws and parasitize on seniors who are the weakest social group,” said Vladimír Velčovský, the Director General of the CTIA.

From the beginning of 2013, appropriate trade licensing offices lawfully revoked trade licences of at least four commercial subjects that organized demonstration sales events especially for seniors. Revoking of a trader’s licence also concerns regulated trade, e.g. provision or intermediation of consumer credit.

•    1. Česká reklamní společnost, s. r. o. (IČ 242 09 341)
o    Trade licence revoked by August 13, 2013
o    In the period from 2012-13, CTIA imposed 25 fines amounting to 5.9 million CZK in total

•    Radek Bargel (IČ 711 25 591)
o    Trade licence revoked by July 29, 2013
o    In the period from 2012-13, CTIA imposed 4 fines amounting to 51,000 CZK in total

•    Reklamní společnost SENIOR, s. r. o. (IČ 242 85 102)
o    Trade licence revoked by July 2, 2013
o    In the period from 2012-13, CTIA imposed 6 fines amounting to 880,000 CZK in total; other five administrative proceedings have not ended, yet

•    Cool Home, s. r. o. (IČ 290 48 087)
o    Trade licence revoked by March 19, 2013
o    In the period from 2012-13, CTIA imposed 5 fines amounting to 262,000 CZK in total

In most cases, sanctions were imposed for violations of the Act on Consumer Protection, especially for repeated illegal use of unfair commercial practices, including deceitful and aggressive commercial practices, at demonstration sales events – failure to provide truthful and complete information about products, conditions of withdrawal from the contract and so forth.

As from November 2012, the Czech Trade Inspection Authority issued at least 13 suggestions to revoke trade licences to commercial subjects and other suggestions, including 8 cases of organizers of demonstration sales events, are in progress at present.
